What is EB5?

The EB-5, also known as the Immigrant Investor Program, is a category of visa administered by The United States Citizenship and Immigration Services (USCIS). The purpose of the program is to generate economic growth and create jobs in the US through foreign capital investments.

This program which was created by the United States Congress' Immigration Act of 1990 thus gives foreign entrepreneurs the opportunity to obtain green cards and work in the United States after they have invested in an American commercial enterprise.

The EB-5 investor visa also benefits the United States economy including United States communities that are economically backward, United States workers, and the foreign national investors. The goal of the EB-5 investor visa program is to create a “win-win” scenario for all parties involved.

Who is eligible?

Any investor who can prove that the type of capital invested by them was acquired, directly or indirectly through lawful means is eligible for the program.

Also, if an investor has a sufficient level of income or has accumulated wealth to meet the requisite amount can participate in the program.

Capital Investment Criteria

The source of capital must fulfill the following criteria:

  • Must be money that can be traced
  • Will need to provide tax returns, bank statements, etc.
  • Money can be gifted
  • All money has to be from a legitimate source
  • Must comply with all tax laws in the US and source country
  • Money can be in US already Foreign investors have three options
  • Invest a minimum of $1 million in a new commercial entity that directly results in the creation of a minimum of ten jobs.
  • Invest a minimum of $1 million in a regional center that indirectly or directly results in the creation of a minimum of ten jobs.
  • Invest a minimum of $500,000 in a new commercial entity or regional center that is located in a 'targeted employment area' that indirectly or directly results in the creation of a minimum of ten jobs.

The EB5 Process

The EB-5 Visa process starts with the submission of the I-526 application and culminates in the acquisition of a permanent unconditional Green Card for the investor. The whole process takes around 7 years.

Here are the various steps in the EB5 process:

  • The investor submits an I-526 application, prepared by the experienced immigration attorney, accompanied by 5 years of tax returns to substantiate the source of investment funds. The approval of the I-526 takes from 16-18 months.
  • After due diligence, USCIS approves the investor's Green Card which is conditional for a period of 24 months.
  • Between 21-24 months, the investor can file an application with the USCIS for removal of the conditional Green Card.
  • The investor is given a permanent Green Card a total of five years after the approval of the conditional Green Card provided all conditions regarding US residency and other requirements are fulfilled.
